A Prisoner's Guide to Trans Rights

This toolkit has been produced by Prisoners’ Advice Service (PAS) and is written for prisoners who identify as transgender, transsexual or non-binary. The guide provides information about:

  • Your rights as a transgender / nonbinary person in prison

  • What a transgender ‘case board’ is and how they make decisions

  • How to apply for a Gender Recognition Certificate in prison

  • Health care issues

  • Searches in prison

  • Dealing with harassment or abuse

  • What to do if you think your rights are not being respected

The first edition of the toolkit was published in November 2020. A new edition was published in December 2023. This 2nd version reflects changes made to official policy by the Ministry of Justice. The changes in policy relate specifically to location decisions for trans women (i.e whether they will be held in a men’s prison or a woman’s prison). The changes also relate to the rules around when prison officers can disclose that a person has a Gender Recognition Certificate.

This guide applies to prison policy in England & Wales only.
